This document is published in accordance with the provisions of Rule 3 of the Information Technology (Intermediaries guidelines) Rules, 2011 that provide for the due diligence to be exercised by the Website.
One QuickPe Systems Limited ("QuickPe" "we" or "us", which also includes its affiliates) is an authorized payment and settlement system under the Payment and Settlement Systems Act, 2007. We issue semi-closed system prepaid payment instruments ("QuickPe Wallet") to Holders on which they can load and transfer funds in Indian Rupees within India to make purchases or avail of certain financial services ("Service(s)"). QuickPe has its registered office situated at One QuickPe Systems Limited, India. We have employees and authorized representatives ("Team").

YOUR AGREEMENT WITH QUICKPE
- We reserve the right to modify the Terms at any time without giving you any prior notice. Your use of the Website following any such modification constitutes your agreement to follow and be bound by the Terms as modified. - We make the Website available as a part of our Service to Holders and Merchants. We may, but have no obligation to, have non user-posted information reviewed by the Website's editorial personnel.

Neither the authors, the editorial personnel, nor any other party who has been involved in the preparation or publication of this work can assure you that the information contained herein is in every respect accurate or complete, and they are not responsible for any errors or omissions or for the results obtained from the use of such information.
USE OF SERVICES AND INFORMATION ON THE WEBSITE
- In order to access certain Services, you may be required to provide information about yourself (such as identification, contact or payment details) as part of the registration process for the Service, or as part of your continued use of the Services. - In terms of Information and Technology Act,2000 read with Information Technology (Intermediary guidelines) Rules, 2011, QuickPe securely transmits and saves your data including but not limiting to the interactions done by the user on the QuickPe App, the transactions undertaken by the user via QuickPe including the exchange of short message service, to our secure servers. The same enables QuickPe to not only serve its users with better offers but also with reminders and notifications for activities more in-line for users interests.
- Information provided by QuickPe or otherwise obtained from the Website will not be used for any unauthorized and unlawful purpose;
- You agree not to access (or attempt to access) any of the Services by any means other than through the interface that is provided by QuickPe, unless you have been specifically allowed to do so in a separate agreement with us;
- You agree that you will not engage in any activity that interferes with or disrupts the Services (or the servers and networks which are connected to the Services);
- You agree that you will not reproduce, duplicate, copy, transfer, license, rent, sell, trade or resell the information obtained from the Website for any purpose whatsoever;
- You agree that you are solely responsible for (and that QuickPe has no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which QuickPe may suffer) of any such breach.

It is important that you act responsibly when providing such Posted Information. Do not use inappropriate language, make gratuitous personal criticisms or comments. - Impersonating the Services or a QuickPe Team member;

- Putting on QuickPe's system any content that contains software viruses, trojan horses or any other computer code, files, or programs designed to interrupt, destroy, or limit functionality of any computer software or hardware or telecommunications equipment;
- Manipulating Service identifiers in order to disguise the origin of any content transmitted via the Services;
- Collecting or storing personal data about other users;

GENERAL LIMITATION OF LIABILITY AND INDEMNIFICATION
Your sole and exclusive remedy for any dispute with us is the suspension of your QuickPe account. In no event shall our total cumulative liability to you for any and all claims relating to or arising out of your use of the Website, regardless of the form of action, exceed INR 1000 /- (Indian Rupees [ONE THOUSAND] only).
In no event shall we be liable to you (or to any third party claiming under or through you) for any indirect, special, incidental, consequential or exemplary damages arising from your use of, or inability to use, the Website. These exclusions apply to any claims for lost profits, lost data, loss of goodwill, work stoppage, computer failure or malfunction, any other commercial damages or losses, even if we knew or should have known of the possibility of such damages.

UNENFORCEABLE PROVISIONS

QuickPe Wallet Features
QuickPe is an authorized Payment and Settlement System under the Payment and Settlement Act 2007.It issues semi closed Pre – paid instruments (“QuickPe Wallet”) to Holders/Users on which they can load and transfer funds in Indian currency to make purchases of commodities or avail financial services from different Merchants.
As per law and relevant KYC Guidelines , QuickPe wallets are issued either on submission of Minimum Wallet ( “ Minimum KYC Wallet”) details which shall include mobile number verified with One Time Pin and self-declaration of name and unique identification number of any of the “ officially valid document” defined under PML Rules,2005 or on the submission of complete documents (“ KYC Compliant Wallet”) these shall only be issued after completing KYC of the PPI Holder . QuickPe Wallet will be valid for an indefinite period subject to the limitations provided under law; any changes to the same will be communicated by updating these terms and conditions

Above parameters and limit capping is applicable as per the Master direction on issuance and operation of prepaid card instruments dated August 27, 2021, as updated on November 12,2021, and subject to change as when new guidelines are issued by RBI.
Terms and Conditions for V-KYC
- Definitions:
In these Terms applicable to the Video based KYC process the following words and phrases shall have the meaning stated hereunder unless indicated otherwise:
- “User” shall mean a Resident Indian individual applicant who applies for any product/facility with QuickPe subject to such product/facility specific terms and conditions as may be specified by QuickPe from time to time.
- “KYC” shall mean the ‘Know Your Customer’ process to be completed by QuickPe as per applicable regulations and guidelines.
- “Product” / “Facility” shall mean any QuickPe product or facility that the User has applied/requested for and in respect of which the User has consented to complete the KYC through the Video KYC process.
- “Video KYC process” / “V-KYC” shall mean the process of KYC verification conducted through a video call feature supported by QuickPe in line with extant regulations and QuickPe policy.
- “Primary Terms and Conditions” shall mean the terms applicable to the Product/Facility being availed by the User.
- “Platform” shall mean QuickPe’s website_______ and QuickPe App.
- Applicability of the Terms:
These Terms and primary Terms and Conditions form the express contract between the User and QuickPe. The User shall apply to QuickPe in the prescribed form for the Product/Facility. By applying, the User acknowledges that he has read, understood and accepted these Terms and the primary Terms and Conditions as applicable.
- General Terms for V-KYC process:
- Requirements for availing of V-KYC feature:
- V-KYC process is available only for Users who are physically present in India and if the same can be confirmed through their live location through geo- tagging and shall be accessible only during the working hours defined by QuickPe;
- V-KYC process shall not be available during National holidays;
- V-KYC process shall work only in good network/internet conditions and
- User should possess requisite documents and materials as informed on the journey page at the time of the V-KYC process to avoid any inconvenience.
- On opting for V-KYC process, a two-way video call will be initiated between the User and QuickPe official to start the V-KYC process.
- As a part of V-KYC process, the User shall be required to verify their identity by answering certain questions asked by QuickPe officials through a video call. By proceeding with the video call, the User accepts the Terms herein.
- The User shall be required to co-operate with QuickPe officials in every manner and provide all such relevant information/data/documents including but not limited to allowing QuickPe officials to capture their photographs, photographs/screenshots of various documents (including but not limited to Officially Valid Documents (“OVD”), PAN, etc.), screenshot of the User’s signature on a plain paper as submitted by the User during V-KYC process as and when requested by QuickPe officials. The User agrees and consents to co-operate and provide all such relevant data/documents, etc. for the purpose of V-KYC process.
- The User herein agrees to adhere to the following during the course of the V-KYC process:-
- Be professional and respectful with the verification executive.
- No profanity, nudity, or illegal activity is allowed during the process.
- Cooperation is necessary for successful VKYC completion.
Note:- non-compliance of any of the above by the Users may result in account suspension or process termination.
- The User authorises QuickPe to collect/store/verify any and all information/details received through the V-KYC process including but not limited to the video call itself, information received from documents/information captured/shared through the video call.
- In case the documents shown and verified by QuickPe officials over a video call do not comply with the QuickPe policy and/or relevant guidelines due to any reason whatsoever, the application request shall be rejected, and it will be converted to the offline KYC mode. Users need to follow the offline KYC process to complete their KYC verification process in such case for completion of the Product/Facility application request.The User agrees and understands that the image of the signature crop provided by the User shall be updated in QuickPe records as the User’s specimen signature.
- Users who have opted for V-KYC process for the Product/Facility application agree that their request is subject to verification and may be rejected by QuickPe for various reasons including, but not limited to:
- Call drop due to network/internet issues at the User’s or QuickPe’s end; or
- Documents matching criteria is not fulfilled or
- QuickPe official is unable to capture the screenshot of User’s photo or any document or
- User is not ready to co-operate with the officials of QuickPe or
- Signature process is incomplete or
- Location outside India, face mis-match, poor quality uploaded documents or
- For any other reason at the discretion of QuickPe.
In case of such rejection, Users need to follow the offline KYC process to complete their KYC verification process for completion of the Product/Facility application request.
- The User understands that the V-KYC process is subject to the availability of QuickPe officials to conduct such V-KYC, and technical stipulations including but not limited to those arising due to any delay, interruption, suspension, resolution or error of QuickPe in receiving and processing the request and in formulating and returning responses or any failure, delay, interruption, suspension, restriction, or error in transmission of any information or request to and from the telecommunication equipment of the User and the network of any internet service provider and QuickPe's system or any breakdown, interruption, suspension or failure of the telecommunication equipment of the User, or QuickPe's system or the network of any internet service provider and/or any third party who provides such services as is necessary to provide the V-KYC process.
- Fees
QuickPe reserves the right to charge fees in relation to the use and/or termination of the Product / Facility including, without limitation, to revise such fees. QuickPe shall determine and give reasonable notice to the User of the rate of any fee from time to time before they become effective, which shall be binding on the User if the User continues to maintain or use the services on or after the effective date. Fees may be collected from the User in such manner and at such intervals as QuickPe may specify.
- Acceptance of Terms and Conditions:
By accepting these terms and conditions in the digital journey of the V-KYC process, the User shall be deemed to have accorded his approval/consent to (i) complete the KYC verification for the Product/Facility application through V-KYC process (ii) the consents, authorisations, declarations, and undertakings, etc. mentioned therein.
- Miscellaneous:
- User agrees that all costs incurred at the User’s end (technical/data plan related or otherwise) for completing the V-KYC process shall be borne by the User solely.
- The User agrees that QuickPe shall not be liable for any connectivity/signal/data related issues leading to incomplete information/application being provided by the User.
- In case the Video based KYC process is not completed/submitted for any reason whatsoever, QuickPe may contact the User for completing offline KYC.
- User hereby agrees to indemnify, defend and hold harmless QuickPe from and against any and all liability, loss that may occur, arise from reliance by QuickPe on the information, declarations, documents, images and undertakings, etc. provided by the User (on account of them being fake/incorrect/erroneous), the usage of online/offline mode for the Product/Facility application including the details provided basis this V-KYC process or breach, non-performance or inadequate performance by the User of any of these Terms, Primary Terms and Conditions or the acts, errors, representations, misrepresentations, misconduct or negligence of the User in performance of its obligations.
- In case of any inconsistency/inaccuracy/non-completion of any formalities in the V-KYC process or for any other reason whatsoever, QuickPe may contact the User for offline completion of KYC. The User agrees and confirms that QuickPe shall at its sole discretion reject the Product/Facility application for any reason whatsoever including but not limited reasons attributable to erroneous, incomplete, misleading information or non-adherence with the relevant norms/non submission of KYC documents to QuickPe or upon any notice/directions received from any other regulatory body.
- QuickPe reserves the right, at any time and from time to time, with or without notice, to cancel, withdraw, suspend, vary, change, add to or supplement the V-KYC process and facilities offered to Users hereunder.
- Change of Terms:
QuickPe shall have the absolute discretion to amend or supplement any of these Terms at any time. QuickPe may communicate the amended Terms by hosting the same on the Website or in any other manner as decided by QuickPe.
- Limitation of Liability
- Neither QuickPe nor its employees shall be responsible or liable in any way for any direct or consequential loss suffered by the User or any third party or towards any claims that may arise due to the rejections of the Product/Facility application due to the V-KYC process availed by the User.
- QuickPe shall not be liable for any failure to perform any obligation contained in these Terms or for any loss or damage whatsoever suffered or incurred by the User or a third party howsoever caused and whether such loss or damage is attributable (directly or indirectly) to any dispute or any other matter or circumstances whatsoever.
- Under no circumstances shall QuickPe be liable to the User or a third party for any indirect, incidental, consequential, special or exemplary loss or damages in connection with the V-KYC process.
- Force Majeure:
QuickPe shall not be liable for any losses caused by its inability or delay in providing the V-KYC process or fulfilling any of QuickPe’s obligations hereunder, either wholly or in part, caused by or in connection with any force majeure events including, but not limited to, restrictions on convertibility, transferability, requisitions, hacking, involuntary transfers, riot, disturbance, strikes, lock-outs, bandhs, war, civil strife, burglary, theft, dacoit, accident, hacking, technical fault including problems related to computers, accessories, software, printers, fax machines, internet, telephone system and such related hardware and software beyond the control of QuickPe, breach of trust by any authorised persons, flood, epidemic/pandemic, fire, earthquake, act of God, act of any Government, change in regulation or law and other allied acts of regulatory or statutory nature or if the performance of such obligation or provision of such service would result in the breach of any law, regulation or other requirement of any governmental or other authority or on account of any other restriction or requisition or other circumstances or events whatsoever beyond the control of QuickPe and QuickPe shall not be obliged to provide any service or facility or perform any of its obligations hereunder during the period while QuickPe’s performance is affected by force majeure conditions. QuickPe shall not be responsible for any loss or damage caused to the User by reason of any failure to comply with the User instructions, when such failure is caused due to reasons beyond the control of QuickPe, the opinion of QuickPe being final in this regard.
- Governing Law:
The laws of India shall govern these Terms. The User hereby agrees that any legal action or proceeding arising out of the Terms shall be brought in the courts or tribunals at Hydearabad in India and irrevocably submit themselves to the jurisdiction of such courts and tribunals. QuickPe may, however, in its absolute discretion, commence any legal action or proceedings arising out of the Terms in any other court, tribunal or other appropriate forum, and the User hereby consents to that jurisdiction.
Note:- Further, in case of inconsistency between the Terms and any specific term and condition pertaining to a specific Product/Facility, the specific term and condition of that particular Product/Facility shall prevail.
QuickPe Wallet can be loaded through online payment methods such as domestic credit/debit card and net banking. However, you will not be able to use prepaid cards, EMI, cards issued outside India or a combination of cards to add/load amount to your Wallet. Such loads will be as per the prescribed limits for Min KYC and Full KYC accounts, mentioned under these T&Cs and as provided by RBI from time to time. Except as provided hereunder, amount in your Wallet will not be refunded to you under any circumstances. No refund will be provided in cash, at any point of time. No interest will be paid on the amount in the Wallet at any point of time. Further, convenience fee charged on add money transactions for loading money to the QuickPe Wallet shall be non-refundable.
The Login used for your QuickPe Wallet shall give You access to all other Services being offered on our Platform .
Fees and Charges:
QuickPe reserves the right to impose and/or revise charges/commissions in relation to the use of your QuickPe Wallet (“Wallet”), in its sole discretion, without any prior notice.

You agree and acknowledge that QuickPe is only a facilitator and is not and cannot be a party to or control in any manner any transactions relating to purchase of goods and/or services using QuickPe Wallet.

What is National Payments Corporation of India (NPCI)?
NPCI is an authorized payment system operator by RBI. NPCI owns and operates UPI payment system.
What is a PSP bank?
PSP is the banking company authorized to act as a Payment Service Provider (PSP) under the UPI framework. PSP engages the TPAP to provide UPI services to the end-user customers.
For the purpose of UPI transaction, customer can visit the PSP bank's website for PSP Terms and Conditions.
What is TPAP?
Third Party Application Provider (TPAP) is an entity that provides the UPI compliant app(s) to the end-user customers to facilitate UPI based payment transactions.
What is Customer’s Bank?
The Bank where the end-user customer maintains his/her account that has been linked for the purpose of debiting/crediting the payment transactions made through UPI.
Who is an End User Customer?
The end-user customer is the individual who uses UPI payment facility to send and receive payments.
We hereby confirm that:
- QuickPe is a TPAP authorized by NPCI to facilitate payments through PSP Bank(s) namely HDFC Bank Limited. We are a service provider and we participate in UPI through the PSP Bank.
- We are bound by the tripartite agreement entered with the sponsor PSP Bank HDFC Bank Limited and NPCI. We are responsible for facilitating grievances / complaints resolution of the customers on-boarded on our UPI application.
- We shall be the first point of contact for all UPI related grievances/complaints for customers on-boarded by us. In case the complaint/grievance remains unresolved, the next level for escalation will be the PSP Bank, followed by the bank (where you maintain the account) and NPCI in the same order. After exercising these options you can approach the Banking Ombudsman and / or the Ombudsman for Digital Complaints, as the case may be.
